fa تبیین الگوی نظام مسائل ژنتیک انسانی Explaining the System Model of Human Genetic Problems ژنتیک انسانی Subject 03 پژوهشی کامل Applicable <div style="text-align: justify;">ژنتیک انسانی به‌مثابه یکی از برجسته‌ترین حوزه‌های نوپدید زیست‌فناوری، در دهه‌های اخیر در کنار پیشرفت‌های چشمگیر علمی، با طیفی از مسائل پیچیده در عرصه‌های پزشکی، اجتماعی، اخلاقی، حقوقی و فقهی همراه شده است. تنوع و پراکندگی این مسائل، لزوم طراحی الگویی نظام‌مند برای شناسایی، سامان‌دهی و تحلیل ساختارمند آن‌ها را به‌طور جدی برجسته می‌سازد. پژوهش حاضر با هدف تبیین الگوی نظام مسائل ژنتیک انسانی و ارائه چارچوبی منسجم برای فهم و تحلیل پیوندهای درونی میان ابعاد علمی و فقهی ـ حقوقی این حوزه انجام شده است. این مطالعه با استفاده از روش تحلیل محتوای کیفی و رویکردی بین‌رشته‌ای، مجموعه گسترده‌ای از منابع علمی شامل مقالات پژوهشی، آثار تخصصی، نشست‌های علمی و گزارش‌های سیاستی را بررسی کرده است. نتایج تحقیق نشان داد که مسائل ژنتیک انسانی را می‌توان در قالب ساختاری چندسطحی و منسجم سازمان‌دهی کرد؛ ساختاری که از تقسیم‌بندی‌های علمی ژنتیک انسانی، شامل ژنتیک مولکولی، پزشکی، جمعیت، رفتاری، تطبیقی و محیطی آغاز می‌شود و فراتر از شناسایی صرف موضوعات و مسائل فلسفی، اخلاقی، اجتماعی، اقتصادی و روان‌شناختی، به‌طور خاص بر تبیین نسبت میان یافته‌های علمی و چالش‌ها و مسائل فقهی و حقوقی ناشی از فناوری‌ها و تکنیک‌های نوین ژنتیکی تمرکز دارد. بر این اساس، تلاش شد نظامی جامع از مسائل فقهی و حقوقی ژنتیک انسانی بر پایه ارتباطی نظام‌مند میان داده‌های علمی و مبانی فقهی و حقوقی تدوین گردد که می‌تواند به عنوان الگویی راهبردی در طراحی رشته «فقه زیست‌فناوری» مورد استفاده قرار گیرد. از جمله مباحث شاخص این رشته به جز مباحث مربوط به روش شناسی اجتهادی، وضعیت فقهی و حقوقی و قواعد فقهی عام و خاص ژنتیک انسانی، می‌توان به فقه اعمال حاکمیت و حکمرانی، مالکیت مادی و معنوی و همچنین مباحث مربوط به قراردادها و رابطه فقهی و حقوقی میان افراد اشاره کرد. <div></div></div> <div style="text-align: justify;">Human genetics, as one of the most prominent emerging fields of biotechnology, has in recent decades—alongside remarkable scientific advances—been accompanied by a wide range of complex medical, social, ethical, legal, and jurisprudential (fiqh-related) issues. The diversity and dispersion of these issues underscore the pressing need for a systematic model capable of identifying, organizing, and structurally analyzing them within a coherent structure. The present study aims to articulate a structured model of the problem system in human genetics and to propose an integrated framework for understanding and examining the internal relationships between the scientific dimensions and the jurisprudential–legal aspects of this field. This research employs qualitative content analysis within an interdisciplinary approach and examines an extensive body of scientific sources, including peer-reviewed articles, specialized scholarly works, academic conferences, and policy reports. The findings of the study indicate that issues in human genetics can be organized within a multi-layered and coherent structure. This structure begins with the established scientific classifications of human genetics, including molecular, medical, population, behavioral, comparative, and environmental genetics, and extends beyond the mere identification of philosophical, ethical, social, economic, and psychological issues. Specifically, it emphasizes clarifying the relationship between scientific findings and the jurisprudential and legal challenges and issues arising from contemporary genetic technologies and techniques. Accordingly, the study developed a comprehensive system of jurisprudential and legal issues in human genetics based on a systematic integration between scientific data and jurisprudential and legal foundations. This framework can serve as a strategic model for the design and development of the academic discipline of “Biotechnology Jurisprudence.” Key topics within this discipline, in addition to methodological issues related to ijtihād, legal status, and general and specific jurisprudential rules of human genetics, include the jurisprudence of governance and regulatory authority, material and intellectual property rights, as well as contractual matters and the jurisprudential and legal relationships among individuals.</div> ژنتیک انسانی, نظام جامع مسائل, چالش‌های علمی, مسائل فقهی, اخلاق زیستی.
